Agreement to Terms

By accessing or using the Filldeck mobile application and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.

Use of Services

Eligibility

You must be at least 18 years old to use Filldeck. By using our services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To use Filldeck, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code or malware
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to our systems
• Use the service to compete with Filldeck

Fuel Delivery Services

Orders

When you place an order through Filldeck:

• You are making an offer to purchase fuel from a verified petroleum station
• The station has the right to accept or decline your order
• Once accepted, a binding contract is formed between you and the station
• Filldeck acts as a platform facilitating the transaction

Delivery

You must be present or have an authorized representative present to receive the delivery. Delivery times are estimates and may vary due to factors beyond our control.

Cancellations and Refunds

Orders may be cancelled before the delivery process begins. Once delivery has started, cancellations may not be possible. Refunds are handled on a case-by-case basis according to our refund policy.

Payments and Fees

You agree to pay all charges incurred through your account, including:

• Fuel costs as set by the petroleum station
• Delivery fees
• Applicable taxes
• Any subscription fees for Business or Enterprise plans

All prices are displayed in USD and are subject to change. We reserve the right to modify our pricing with notice.

Intellectual Property

The Filldeck app, including its content, features, and functionality, is owned by Filldeck and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Disclaimers and Limitation of Liability

Service "As Is"

Filldeck is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Filldeck shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid to Filldeck in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Filldeck, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will immediately cease.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in San Francisco, California.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the service after changes constitutes acceptance of the new Terms.
